INTRODUCTION
HRqueen is owned by First Champion (HK) Co. Ltd, a limited liability company incorporated in Hong Kong, herewith called (the "We", "Service Provider", "Sub-supplier" of Master International A/S) is committed to protecting and respecting your privacy.
Master International A/S, the owner company of "Master People Platform SaaS", is a limited liability company incorporated under the laws of Denmark, herewith called "Master International", "Supplier" or "the test provider".
DEFINITION:
"Master People Platform" shall mean Master International's digital test and assessment platform with workflows that empowers the central usage of assessments and analytics in recruitment and talent development.
1. DATA PRIVACY COVERED FOR Master People Platform ("MPP")
PLEASE BE AWARE THAT CUSTOMERS WHO WILL SUBSCRIBE THE MASTER INTERNATIONAL MASTER PEOPLE PLATFORM SAAS LICENCE WILL SEPARENTLY RECEIVE THE SAAS AGREEMENT and THE ADDENDUM FOR DATA PROCESSING AGREEMENT AS TERMS AND CONDITIONS SET OUT BY MASTER INTRNATIONAL A/S, AND SHALL AGREE THE AGREEMENT THERETO BEFORE THE ACCESS AND USE OF MPP.
Master International has partnered with the law firm Plesner and received 3rd party certification from Deloitte for our GDPR compliance, in accordance with the ISAE 3000 standard. When processing personal data, e.g. for HR purposes, Customers are required to actively take responsibility for how the data are handled. With the Master METIS platform both the candidates' as well as the customers employees' test results are consolidated in a single system. Not only is the HR flow in Master METIS fully data driven, it also ensures that the subjects' personal data, be it data from candidates or employees, is 100% in compliance with the GDPR, even after they have left your company. For Customers who will use the service of HRqueen for delivery of Master International tests under the SaaS license of HRqueen, HRqueen, hereafter called ("We") are following the Privacy Policy as set by Master International A/S as a strict guideline for handling of privacy data for Customers.
2. DATA PRIVACY COVERED FOR OTHER SERVICES PROVIDED BY HRQUEEN
We, HRqueen have aligned with the GDPR compliance requirement, and the Personal Data (Privacy) Ordinance of Hong Kong (Cap.486). We protect all data as we collect when you visit our website, contact us by email, phone or through one of our social channels, or through other communications.
3. PROCESSING OF PERSONAL INFORMATION
3.1 Information provided by our Customers:
The categories of personal data processed by us varies between Customers based on service delivered, service request recommendation from clients, the level of information may include the following:
Categories of data subjects:
- Customers' Employees
- Applicants to jobs and potential candidates of the Customers
- When the Customer offers assessments as a service, data subjects may include employees, applicants and potential candidates of their respective customers.
Minimise information collection:
- Requestor
- Requestor Email address
- Test taker name, email address, phone number
- Answers to test, Tests and Assessment Results
- Location data
- Business name, email and contact
3.2 Information provided to HRqueen via our website:
HRqueen process all information Customers provide to us via our website (www.hrqueen.net), by telephone, email or otherwise. This includes information you provide when you register for our services as Customer, enquire about a product or service, use one of the social media functions linked to our website, or when you report a problem with our website.
The categories of personal data processed by us varies between Customers, but may include:
- Name
- Job title
- Email address
- Telephone number
- Location data
- Details about how you browse our websites and platform
3.3 Purposes and bases for processing your personal data
We may use your data for the following purposes:
Send test link to test takers, acknowledge test is completed
Facilitate purchase order of our services
Business management, forecasting and statistical analysis
Prevention and detection of crime including money laundering, fraud or other crimes
Reminder of your licence renewal or future expiry date
Process data in Master People Platform
Only the Customer and persons authorised by the Customer have access to the Customer's partition in Master People Platform. The Customer can create, edit and delete data on the Master People Platform as long as he or she is a Customer or an authorized representative of the Customer. The Customer shall use the functionality of the Platform to perform any required action to the extent possible, If the Customer needs further support, the Customer has to give/grant access to the Service Provider or Supplier and in writing confirm the timeframe and purpose for the support for which the access is granted.
The Customer's use and configuration of the software and of the features of the Master People Platform are the instructions for processing of data. The results of the processing are created and provided by such instructions
3.4.1 Categories of data subjects
- Employees of the Customers.
- Candidates to jobs application to the Customers.
- When the Customer offers assessments as a service, data subjects may include employees, applicants and potential candidates of their respective customers.
3.5 Our website links
If sharing your personal data becomes necessary for the purpose for providing our service to you, we will only share it where appropriate safeguard are in place to ensure your data is protected to the same standard expected under the GDPR.
Our website includes links to social media platform (Facebook, Instagram. LinkedIn, WeChat, WhatsApp). Once you navigate away from our website via one of the links, the website may collect your IP address and may set a cookie on your device. When you use one of these links, you are sharing information to another website or service and this Notice will no longer apply. Please read the privacy notices provided by the particular service website you are directed to, before posting any personal information using these links.
4. CONFIDENTIALITY
The Service Provider and Supplier shall keep the personal data confidential.
4.1 The Service Provider and Supplier shall not disclose the personal data to third parties or take copies of personal data unless strictly necessary for the performance of the Service Provider and Supplier's obligations towards the Customer according to the Agreement, and on condition that whoever personal data is disclosed to is familiar with the confidential nature of the data and has accepted to keep the personal data confidential in accordance with this Agreement.
4.2 The Service Provider and Supplier are legal entity, thus all terms of the Agreement apply to any of the Service Provider and Supplier's employees and must ensure that its employees comply with the Agreement.
4.3 The Service Provider and Supplier must limit the access to personal data to employees for whom access to said data is necessary to fulfil the Supplier's obligations towards the Customer.
4.4 The obligations of the Service Provider and Supplier under Clause 4 persist without time limitation and regardless of whether the cooperation of the Parties has been terminated.
4.6 The Customer shall treat confidential information received from the Service Provider and Supplier confidentially and may not unlawfully use or disclose the confidential information
5. PERSONAL DATA FOR MARKETING COMMUNICATIONS
5.1 Direct marketing communications
To market, promote, and drive engagement of our products and services, we use non-identifiable personal data to send promotional communications that may be of specific interest to you. These communications are to drive your engagement and maximise the value of our services to you. Occasionally, we will use your business company logo and/or name for marketing and promotional communications through platforms like our website, SMS, WhatsApp, Telegram and more.
In particular, by submitting a "Contact Us", or "Free Consultation", or "Book a Complimentary Call" form on our Website, you consent to receive email messages, text messages, phone calls, and postal mail, including that of a promotional nature, from HRqueen. Where local law permits, you consent to receive phone calls from HRqueen and its affiliates, even if your phone number is listed on the "Do Not Call" registry. You may not provide consent on behalf of someone else or provide someone else's contact information.
In terms of direct marketing communications, your personal data is stored for marketing purposes as long as you have not objected to such marketing communication and/or the subscription to the email newsletter is active, as the case may be. Similarly, You can opt-out of receiving our direct marketing communications at any time through our unsubscribe or opt-out mechanisms provided, or by contacting us at compliance@hrqueen.net.
If an opt-out request is received, you may still receive communications from us for up to ten (10) business days as we process the opt-out request. We reserve the right to continue sending out communications regarding service announcements, administrative messages, and accounts administration relating to HRqueen that are necessary to our relationship with you. All data will be processed in accordance with this Privacy Policy.
In addition to the above, please note that you have the right to make a complaint at any time in writing to the Information Commissioner's Office if you are concerned about the way in which we are handling your personal data.
6. DATA RETENTION
6.1 We will retain your personal data for as long as is necessary to provide you with our products and ongoing services and for a reasonable period thereafter, to enable us to meet our contractual and legal obligations and to deal with complaints and claims. At the end of the retention period, your personal data will be securely deleted in accordance with our Personal Data Retention Policy.
6.2 On the Customer's request, the Supplier shall immediately transfer or delete or duly anonymise personal data, which the Supplier is processing for the Customer, unless Union or member state law requires storage of the personal data.
7. TEST TAKERS INFORMATION
We collect and use personal information about the test takers who may be the selected candidates from yours or employees. In general, we only collect and use this personal information as directed by you. We will never use your test takers' information to independently market or advertise to your test takers unless they are also using our applications or services directly.
We will only need to know the test takers information:
- Name
- Email address or business email address as given by you
- Telephone number
8. PRIORITY
If any of the provisions of the Agreement conflict with the provisions of any other written or oral agreement concluded between the Parties, then the provisions of the Data Processing Agreement signed between the Supplier and the Customer shall prevail.
